This policy governs how The GoodOBGyn collects your consent to send marketing communications (via email, SMS, SMS/MMS, or other electronic means), how we manage your preferences, and how you can withdraw or opt out at any time.

1. Legal Basis & Regulatory Context

• Under the UAE’s Personal Data Protection Law (PDPL), processing personal data for direct marketing requires explicit consent from the individual.
  
  
• Silence, pre-ticked boxes, or inactivity does not constitute valid consent. Consent must be freely given, specific, informed, and unambiguous.
  
  
• The newly adopted Cabinet Decision No. 56 of 2024 regulates telemarketing in the UAE, including SMS and social media messages as forms of “telemarketing.” Entities must obtain prior approval from the Telecommunications & Digital Government Regulatory Authority (TDRA) to conduct such marketing.
  
  
• For SMS marketing, the TDRA also prescribes permissible sending hours (generally between 7:00 AM and 9:00 PM) and requirements for sender ID (e.g. prefix “AD”), content labeling, and opt-out instructions.
  
  
• Recipients always have the right to object or withdraw consent, and processing for marketing must stop once consent is revoked.
  
  

2. Obtaining Consent for Marketing

• When you sign up for our newsletter, register with the site, or provide your contact during treatment or inquiry, we will present you with a clear opt-in option (checkbox or toggle) to receive marketing communications about offers, news, updates, or promotions.
  
  
• The request for consent will clearly explain the type(s) of communications (email, SMS, other), the purpose (e.g. health tips, promotional offers, clinic updates), and that you may opt out at any time.
  
  
• Consent must be documented and stored securely so we can demonstrate compliance (i.e. time, method, content of consent).
  
  
• For SMS / telemarketing, in addition to the general consent rules, we will ensure compliance with TDRA requirements (sender ID, timing, content disclosure, recordkeeping).
  
  

3. What Marketing Communications We May Send

If you consent, we may send you:

• Email newsletters with articles, health tips, blog posts
  
  
• Promotional offers, discounts, event invitations
  
  
• SMS / text alerts about special offers or reminders (not medical alerts)
  
  
• Notifications about new services, webinars or clinic updates
  
  

These communications are separate from transactional or service messages (e.g. appointment confirmations, billing, medical test results), which we may send even without marketing consent if required to deliver service.

4. Opt-Out / Withdrawal of Consent

• You may withdraw your consent or stop marketing messages anytime, with immediate effect moving forward.
  
  
• Each marketing email or SMS will carry an unsubscribe link or simple opt-out instruction (e.g. “Reply STOP” for SMS).
  
  
• Upon receiving your opt-out request, we will cease sending non-essential marketing communications to you within a reasonable timeframe (usually up to 5 business days).
  
  
• If you object to marketing, we may still keep minimal contact to send you service messages or legally required notices (e.g. changes to terms).
  
  

5. Recordkeeping, Consent Management & Audit

• We keep records of when and how you gave consent (date, IP, form field, version of policy) to allow audit and compliance verification.
  
  
• We maintain a consent registry and manage preferences (which channels, which topics you agreed to).
  
  
• We periodically review and refresh consent when required (e.g. if new services or marketing categories are added).
  
  

6. Processing & Purpose Limitation

• We use your contact information and preferences solely for the purposes you consented to (e.g. marketing, promotions).
  
  
• We will not use your data for other marketing that you didn’t explicitly agree to.
  
  
• We will not share your marketing preferences or contact information with third parties for their independent marketing without your explicit additional consent.
  
  

7. Cross-Border Transfers & Third Parties

• If marketing data (e.g. email lists) is processed by third-party service providers or outside the UAE, we will ensure proper safeguards (e.g. contractual clauses, encryption) in line with PDPL cross-border requirements.
  
  
• Third parties who perform marketing services (e.g. email platform, SMS provider) will be bound by confidentiality and data protection obligations.
  
  

8. Compliance with Telemarketing Regulations

• We will ensure any SMS, social media messages or telephone marketing are conducted in strict compliance with Cabinet Decision No. 56 of 2024 and regulatory guidelines, including obtaining prior approval from TDRA if required.
  
  
• We will only send promotional SMS between allowed hours (7:00 AM to 9:00 PM) unless otherwise permitted (such as essential or transactional SMS).
  
  
• We will prefix SMS sender names with the required code (e.g. “AD …”) to indicate a marketing message to recipients.
  
  

9. Consequences of Noncompliance & Liability

• We may not send you marketing communications without valid consent; violations risk regulatory fines, suspension of telemarketing license, and reputational harm.
  
  
• If you believe you received unsolicited marketing or your opt-out was ignored, you may contact us and also file a complaint with TDRA or the UAE Data Office.
  
  

10. Changes to This Policy

We may revise this policy from time to time (e.g. to reflect new legal or regulatory requirements). When changes occur, we will post them here and update the “Last updated” date, and if they materially affect your rights, we may notify you by email or site banner.
